SERVICES PROVIDED
Our Services include, but are not limited to:
Websites & Newsletters: Content hosted via Beehiiv.
Community: Community interactions hosted via Discord.
Web Applications: AI-driven training analysis and automation tools (hosted via Lovable/Supabase).
ACCOUNTS AND REGISTRATION
To access certain features (such as our web app or community), you may be required to register an account.
Google SSO: You may register using your Google credentials. You agree that the information provided from your Google account is accurate.
Security: You are responsible for maintaining the confidentiality of your login credentials. You must notify us immediately of any unauthorized use of your account.
Eligibility: You must be at least 18 years old to use our Services.
SUBSCRIPTIONS AND PAYMENTS
Payment Processing: Payments for memberships or subscriptions are processed securely via Stripe. We do not store your full credit card details.
Billing: By providing a payment method, you authorize us (and our processor) to charge the applicable fees.
Renewal: Unless cancelled, subscription services typically renew automatically at the end of the subscription period.
Refunds (Digital Content):
14-Day Cooling-off Period: Under UK Consumer Law, you have 14 days to change your mind and request a refund for digital content.
Waiver: However, if you access, download, or stream the digital content (e.g., start a course or use the premium app features) within this 14-day period, you acknowledge that you lose your right to cancel.
We may, at our discretion, offer a separate money-back guarantee specific to certain products, which will be explicitly stated on the sales page.
USE OF OUR APP AND INTEGRATIONS (GARMIN & GOOGLE)
Garmin Integration: Our app allows you to connect your Garmin account to analyze training data. You acknowledge that any training advice generated is based on the accuracy of the data you provide.
Google Drive Integration: You may choose to connect Google Drive to process files. We only access files you explicitly select.
Acceptable Use: You agree not to misuse our Services, including but not limited to: reverse engineering the app, introducing viruses, or using the automation tools for illegal activities.
HEALTH AND MEDICAL DISCLAIMER (IMPORTANT)
We are not medical professionals.
The training plans, performance indicators, and advice provided by FLOW MOMENTUM LIMITED (and our AI algorithms) are for informational and educational purposes only.
They do not constitute medical advice, diagnosis, or treatment.
Consult a Doctor: You should consult your physician or other health care professional before starting this or any other fitness program to determine if it is right for your needs.
Risk: You understand that physical exercise involves strenuous physical movement and carries the risk of injury. You assume all risk for your participation in the activities suggested by our Services.
INTELLECTUAL PROPERTY
Our Content: All content, software, text, graphics, and logos contained in the Services are the property of FLOW MOMENTUM LIMITED or our licensors and are protected by copyright and other intellectual property laws.
Your License: We grant you a limited, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use.
User Content: You retain ownership of any data or content you submit (e.g., community posts on Discord), but you grant us a license to use it to provide the Services.
LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or for fraud.
To the extent permitted by law:
We are not liable for any indirect, special, or consequential losses (including loss of data, profit, or business interruption).
Our total liability to you for any claims arising out of the Services shall be limited to the amount you paid us in the 12 months preceding the claim.
We do not guarantee that the Services will be uninterrupted, secure, or error-free.
THIRD-PARTY LINKS AND SERVICES
Our Services utilize third-party providers (Beehiiv, Discord, Garmin, Google, etc.). We are not responsible for the content, policies, or practices of these third parties. Your interactions with them are governed by their respective terms.
TERMINATION
We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes relating to these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.
CHANGES TO TERMS
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this site or via email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
